General Terms and Conditions

Area of Application

The present general terms and conditions (in the followingTAC") are valid in the version topical at the time of the conclusion of the contract for all business relations between the Wood & Luxury GmbH, Basel (in the following "Wood & Luxury"), and her customer. They form an integrating and complementary component for all orders which are concluded at the online shop and by phone.

Orders at the online shop are accepted at any time. Orders can also be dispatched by e-mail at info@woodandluxury.ch. These are gladly processed at the following office hours:

Monday – Friday 8.00 a.m. – 5.00 p.m.

Offer & Contract Conclusion

The representation of the offered products on woodandluxury.com or woodandluxury.ch is non-binding and does not constitute a legally binding offer of Wood & Luxury. When a customer places an order via the internet, by phone, email or fax, he/she submits a binding offer for the conclusion of a contract.After the conclusion of the order process the customer receives a confirmation that the order has been transferred successfully to Wood & Luxury. Whereas a confirmation of the receipt of the order does not constitute any acceptance of the offer. Wood & Luxury expressly reserves the rights to refuse an offer without giving any reasons. Only by sending of an order confirmation by Wood & Luxury a legally binding contract is realized.

Property

Wood & Luxury retains ownership of the products until the purchase price has been paid in full. Wood & Luxury is entitled to arrange the registration of the reservation of title at the expenses of the buyer, if it deems its claim to be at risk. 

 

Delivery

Delivery to your desired address

The delivery is made within Switzerland directly to the delivery address and contact personspecified by the customer. Delivery to individuals if accessible is carried out at the front door, to corporate clients at the reception.

 

Shipping and Delivery Costs

The offered products are delivered respectively within the delivery time noted on the website. Should there be deviations from the dates, the customers will be informed early about it. The given delivery times serves merely as an orientation. The disregard of terms of delivery does not entitle the client to claim compensation for any damage nor to withdraw from the contract. The right of withdrawal exists when the products were not delivered within 30 days after the date of delivery given in the order confirmation. Smaller products are delivered by the Swiss post. Bigger products are noted with a forwarding agency sign on the website and are delivered by the forwarding agency. The delivery is to kerbside only. The delivery does not include assembly.

Prices

The prices in the online shop are quoted in CHF, EUR, USD and GBP and contain no VAT. The prices stated at the time of order at the online shop shall be authoritative.

Methods of Payment, Creditworthiness

The following payment methods are available for the payment:

Credit card: VISA, Master Card

Cash payment

The ordered products can also be directly fetched at Wood & Luxury in the St.Alban-Vorstadt 15 in CH-4052 Basel, phone 061 272 18 18. In this case the product is immediately to be paid in cash on the spot.

Prepayment

There is also the possibility of a prepayment on the following account:

PostFinance AG, Bern, CH08 0900 0000 in 4182 1501 7, account holder Wood & Luxury GmbH. In case of prepayment the order is worked on only after entrance of the payment. The customer will be informed about the payment entrance. The terms of delivery are extended accordingly.

The customer entitles Wood & Luxury to carry out credit assessments at its own discretion and to pass on data of the customer for this purpose to third parties if necessary

In case of default of payment, Wood & Luxury is entitled to entrust third parties with the collection of outstanding accounts and to resign the demand to third parties for this purpose.

 

Obligation of Examination

The customer is obliged to check the product after receipt and to give written notice about possible defects to Wood & Luxury immediately, at the latest within 8 days. Any defectsdiscovered later must be notified to us in writing immediately. If the customer failed thecheckup and complaint in time, all guarantee claims of the purchaser will be rendered invalid. 

 

Product Guarantee

Wood & Luxury guarantees that all products were carefully produced in cooperation with the manufacturers. In the process, Wood & Luxury pays attention to the use of particularly environmentally friendly materials. In this matter, Wood & Luxury fulfills high standards. Wood & Luxury grants a warranty period of five years from the billing date. Damage due to normal wear and tear (especially on oiled surfaces) or improper use is excluded from the warranty. To validate the claim under warranty, the purchase documenthas to be sent to Wood& Luxury together with the product at the expense of the customer.Wood & Luxury is at liberty to provide the warranty service in form of a free repair, replacement of similar equipment or a refund of the purchase price.

 

Right of return

The customer has a right of return within 30 days. We therefore provide the customer upon his request with a form. The form has to be returned to Wood & Luxury by e-mail, fax or letter. The cost for the back transport shall be at the expense of the customer. Goods excluded from the right of return are those which were made on the basis of specifications of the customer. In case of an effective return, the contract of purchase shall not be concluded. The services received by both parties are to be returned within 14 days and possible benefits gained (e.g. compensation for use) to be released. In the event of a deterioration of the products replacement of its value can be demanded. This does not apply to products, which deterioration is due solely to the inspection of the products – like it is possible in a shop.

The purchase price or rather the value of the returned goods will be credited onto the customer’s or credit card account without separate notification.

 

Exclusions from Warranty of the Data Communication

The data communication via the internet cannot be guaranteed to be without errors. Consequently, Wood & Luxury is not liable for constant and continuous availability of the online shop. The liability exclusion also applies to electronic errors, which occur during a sales transaction and especially, lead to delayed processing or receiving of orders.

 

Data protection

Collection, processing and use of personal data

Personal data is collected only when the customer has communicated these voluntarily within an order, an opening of a customer account or a registration for the newsletter. The communicated data is used to perform and handle the purchase order. All data is protected with technical and organizational measures. Contract related and other correspondence can occur by Wood & Luxury via e-mail – also unencrypted. When transferring data via e-mail that are beyond the control and influence of Wood & Luxury, there might be potential security risks like viruses, data damage, data loss or interference from third parties. Wood & Luxury guarantees that no customer information would be shared with third parties.

 

Newsletter

The customer is free to subscribe to the newsletter service. The customer receives information about Wood & Luxury, their products, as well as further information about the company. It is possible any time to unsubscribe from the newsletter service. Data Security

Individual-related data will be transmitted safely using SSL encryption during the entire order process. Wood & Luxury safeguards the website and other systems by employing technical and organisational measures against loss, destruction, access, changes or circulation of your data by unauthorised persons. The access to the customer account is possible only after input of your personal password. The customer is obliged to handle his access information with care and to close the browser window if the communication has ended, especially when using the computer together with others.Despite using the most sophisticated security technology to protect the data against unauthorised editing, Wood & Luxury assumes no liability for the safety of data transmitted via the internet.

 

Discounts

Discounts are valid only for the products. Shipping and delivery costs are excluded from the discounts. Discounts cannot be cumulated.

 

Severability Clause

If any provision of these TAC is found to be unenforceable or invalid, the validity of the remaining provisions shall not be affected.
